Using this website is subject to the terms detailed hereinafter (the “Terms of Use”), and by using it, you agree to these terms. These Terms of Use settle the relations between Wise – World Internet Services Engines Ltd. (“Wise”), operating the website [E-Bazaars] (the “Site”) and any person using the information available on the Site or information obtained through the Site and/or publishing an ad on the Site (the “User”).

Internet Information and Contents

Any information you publish on the Site is openly available to all internet users. Be sensible and cautious with any responses and appeals you receive as a result of using the Site and/or publishing any personal information on it, just as you should be whenever contacted not through the internet.

Under those components in the Site that require you to provide personal information (such as the ‘For Sale’ board) you will be requested to provide certain personal information such as your full name, mailing address, electronic mail address, credit card details etc. Such information will be transferred and kept within Wise’s information base. Providing such information is not required by law, but without providing information items marked as “required information” you will not be able to publish on the Site. Providing incorrect information will cause the deletion of your information from the Wise’s information base and you will not be able to publish on the Site.

As part of Wise’s routine activity of maintaining and updating the Site and as required by the nature of the services provided in the Site, Wise may provide information from its base to different advertisers. It is hereby clarified that information provided to advertisers, if any, will not, in any way, enable your personal recognition (such as name, telephone number or electronic mail address).

Wise may occasionally deliver to you by e-mail or SMS information regarding its services as well as marketing and publication materials, either published by Wise or received by Wise from other publishers to be published by Wise. At any time you may contact Wise and ask for the cancellation of your approval for such delivery and stop receiving such materials.

Limitation of Liability (Site Publication)

Any User may publish on and/or use the Site, subject to his compliance with the following accumulated terms:

1.          The User may not impose as another person or use a credit card or any component thereof with a purpose to deceit.

2.          The User may not use the Site to publish any advertisement which content is racist, offensive, includes defamation or is in any other way illegal, including:

2.1.        any content infringing any third party’s proprietary right, including copyrights, trademarks or any other intellectual property rights;

2.2.        any content of pornographic or sexual nature;

2.3.        any content which publication of such content is prohibited by law (i.e. advertisements offering prostitution services);

2.4.        any content that offends a person’s privacy;

2.5.        any content and/or information related to minors and which identifies a minor, a minor’s personal information or a minor’s address and contact information;

2.6.        passwords, user names and other details allowing the use of computer software, digital files, internet website and/or services, requiring registration, whether for fee or for free.

Other than the criminal liability to the abovementioned in sections 1-2, Wise reserves its right to cancel any proposal, which appears or is suspected to be, at Wise’s sole discretion, fraudulent, and to take any legal action against a User not complying with the above prohibitions, including, without derogation, filing a civil claim any damage caused and/or to be caused and/or that might be caused to it and/or to anyone on its behalf and/or to any third parties.

Wise reserves its right to make the final decision regarding the rejection or publication any of the materials provided to it by the Users. Wise reserves its right to edit the publications to match the other publications in the Site. Wise reserves its right to collect any information regarding the usage habits in the Site and internet, and use such information for improving the Site’s services, operation and contents.

Wise does not undertake that a publication in the Site will receive any response. Wise is not able to know what responses (if any) a User will receive following posting a publication on the Site, and it shall bear no responsibility whatsoever towards the User or any one on his behalf for such responses, the identity of the responders or any result caused by the publication. In addition, Wise shall not be responsible in any way to any usage by any third party in the details published by a User.

Wise is not a party to any transaction executed following a publication in the Site and is not an agent in such transactions. All terms of a transaction will be directly agreed upon by the parties to the transaction. Wise shall not be held responsible for the services and products offered in the publications on the Site or purchased through the Site. All details and information published on the Site are at the publisher’s sole responsibility. Furthermore, Wise shall not be held responsible for any errors or mistakes in the information published on the Site, and it shall not be held responsible for any modifications executed by it in the published materials on the Site. The User shall hold all responsibility for his use of the services on the Site. Wise shall bear no responsibility to any damage and/or expenses, direct and/or indirect, caused to the User as a result of his use of the services on the Site.

Since it is impossible to have a thorough clarification regarding the reliability and truthfulness of the publications on the Site, Wise cannot guarantee and/or undertake the truthfulness and accuracy of the publications on the Site.

For the removal of any doubt it is hereby clarifies that the User understands and acknowledges that all the publications on the Site are at the exclusive responsibility of the publisher and Wise shall not be responsible nor liable, in any way, in respect to any of the publications on the Site.

Wise cannot guarantee that the services on the Site will not be interfered, be provided with no interruptions and interferences and/or be immune to any unauthorized access to Wise’s  and/or any of Wise’s service provider’s computers. In cases of damages, breakdowns, faults, hardware, software or communications failures at Wise or any of its suppliers, Wise shall not be held responsible for any damage, direct or indirect, mental anguish etc. caused to the User and/or his property by such. Furthermore, Wise is under no obligation to provide any technical assistance, support or help related to the Site, uploading to and/or downloading from the Site any contents, the use of any equipment etc.. Wise reserves its right to shut down the Site, modify from time to time the Site’s structure and look and the availability of the services and contents provided in it, including the removal of certain publications, all without prior notice to the Users and/or publishers. There shall be no claim, action or demand against Wise for any of the abovementioned actions.

Copyrights/Trademarks

All the pages on the Site are Wise’s property. You may not copy or publish the Site’s pages, in whole or in part, without Wise’s prior written expressed consent. The Site is meant solely for private use and not for commercial use, and it is prohibited to make any changes to it, copy, distribute, transmit, publicly present, duplicate, publish or disclose to third party any part of the Site without Wise’s prior written consent. The User acknowledges that all title and rights in the Site’s name and trademark, as well as the Site’s structure, design and way of presenting the publications – belong, exclusively, to Wise. You may not copy and/or duplicate and/or use any of these for any purpose whatsoever.

Governing Law and Jurisdiction

These Terms of Use are governed by the Israeli Law. The exclusive jurisdiction over any litigation related to and/or resulting from the Site and/or its use is given to the competent courts in Tel-Aviv-Jaffa, Israel.

Miscellaneous

At Wise’s sole discretion, it may occasionally amend these Terms of Use without giving any prior notice. Wise shall publish the new Terms of Use and they shall become valid upon publication on the site.
